House Rules
The following Rules and Regulations are provided by the Emerald Beach Resort HOA. Every guest shall comply with these Rules and Regulations:
• Resort management assumes no liability for any personal property left in a guestroom, parking garage, beach or in any public area.
• No scooters, golf carts, etc. are allowed to be driven or parked on property (Excluding handicapped scooters).
• No roller-blading, skateboarding, bicycling, is allowed in parking garages.
• You must display your valid parking permit at all times. (The parking pass must be displayed on the left driver's side windshield). Failure to do so may result in the towing of your vehicle at your expense. Vehicles parked in a no parking zone or a handicapped spot without proper identification will result in towing at the owner’s expense.
• Smoking is not permitted in any indoor public area.
• Concealed weapons are not permitted on the resort property. This includes, but is not limited to knives, switchblades, and guns.
• Kegs are not allowed on property. All liquor purchased at the resort must be consumed on resort property.
• Items may not be hung from the balcony railing or displayed in the corridors/walkways/hallways. This includes swim wear, beach towels and beach/pool toys.
• It is a felony for anything to come off your balcony. No sitting, leaning, or climbing the balconies. If you are witnessed throwing anything off your balcony, security and the police will be called, and you will be immediately trespassed from property and may be arrested. This includes fireworks, feeding seagulls and spitting.
• No grills (charcoal, gas, or electric) are allowed on association property. There are gas grills in the Floridita pool area that guests may reserve and use.
• The outdoor pools and spas are open from 8:00AM to 10:00PM. Wristbands are required for all guests using the fitness center and outdoor pool areas as well as exiting and entering the beach access areas. Please do not reserve pool chairs or leave personal items unattended on chairs if you are not utilizing the pool area. If pool furniture is not claimed within thirty minutes, then the personal items on or near the furniture will be taken by security or resort personnel to the housekeeping department where they may be recovered by the guests. No one other than security or resort personnel may remove personal items from the pool furniture. Entry onto the pool area after 10:00PM or any misuse of the ADA chair lifts will result in immediate trespass from property.
• No running or horseplay is allowed in the pool areas. Footballs, baseballs, soccer balls or any other object that may cause injury are not allowed in the pool areas.
• Proper swimming attire is required. No cut-off jeans, thongs, or see through bathing suits are permitted. Children 3 and under are required to wear swim diapers.
• You will be required to present your resort band to gain access to the pool area and fitness room. We request you wear your resort band whenever you are in the common areas of the resort.
• No outside alcoholic beverages are allowed on the pool deck or bars. Cooler size on the beachside pool deck is limited to a soft sided, personal sized cooler (10”x6”x8”) that will fit under a chair and fit no more than
4 non-alcoholic cans. All carry items are subject to search.
• No food or beverage is permitted within four feet of the edge of any pool, hot tub, or spa. Glass containers are prohibited in the pool and on the pool deck. Coolers not exceeding 10’ x 6’ x 8’ are permitted on the beachside pool deck only are subject to search by security personnel. Coolers are prohibited on the Floridita pool deck.
• Children 14 and under require adult supervision while using the outdoor pools and pool deck areas.
• When returning to the pool area from the beach, please shower before entering the pools or hot tubs.
• Please help keep our resort clean and beautiful by placing all your trash in trash cans before leaving the pool area.
• Shade canopies/tents are not allowed in front of chairs/umbrellas set up by the authorized beach Services. A designated area, from the east boardwalk to the public access on the west has been allocated for owners and guests who wish to erect tents/canopies. All tents/canopies must be removed from beach by sunset. Tents/canopies left overnight may be removed and disposed of by authorized personnel. Tents/canopies may be placed next to the fence, broken down with tops removed for overnight storage only.
• All trash/debris must be removed from the beach and/or placed in the blue trash containers placed on the beach for everyone’s convenience. Glass containers cannot be taken on the beach.
• No items of any person property, including trash or rubbish, may be left, placed, or stored for any period of time on the walkway outside of a Unit door or on any portion of any condominium property.
• Prohibited Activities.
a) Climbing on or leaning over balconies is prohibited and will result in eviction of guests and fines of not less then $50 per offense.
b) Throwing any item or object, including cigars and cigarettes, from balconies or walkways, is prohibited and will result in eviction of guests and fines of not less then $50 per offense.
c) Feeding seagulls or other birds on Resort property is prohibited.
d) Fireworks, laser pointers, sparklers or any type of fireworks are prohibited.
e) Towels, bathing suits, clothing, rugs, flags, and other items are prohibited from being hung on balcony or walkway railings or from unit windows and will result in fines up to $50 per offense.
f) Walkways, stairways, and vestibules serving two units are fire exit lanes. Nothing, including bicycles, floats, coolers, furniture, beach chairs, etc., shall be left in these areas or any common area walkway at any time.
g) Skateboards, roller skates, roller blades and the like are prohibited on all sidewalks, the swimming pool decks, skybridge, any boardwalks, any gazebos, all stairwells or entryways of the buildings and Units, and the interior of any recreation buildings located on the Resort property.
h) The use or storage of electric, charcoal grills, hibachis, and gas grills is prohibited. Guests will be evicted for violations and will be fined $50 per violation plus damages. This will be enforced in accordance with state and local fire ordinances.
i) No nuisances shall be allowed upon the Resort property. Any use or practice which is the source of unreasonable annoyance to Owners or Occupants or which interferes with the peaceful possession and
proper use of the Resort property is prohibited.
k) Water balloon slingshots and water balloon throwing is prohibited throughout the Resort property.
• Quiet Hours. “Quiet hours” are enforced throughout the resort between 11:00 P.M. and 10:00 A.M. All owners and guests shall refrain from any activity that would disturb other residents at all times, but especially during quiet hours.
Additional Rules:
- Overnight visitors that are not on the reservation are not allowed.
- Max occupancy is 6 humans.
- No parties, events, functions, etc. are allowed in the condo.
- The condo and balcony are non-smoking (including vaping). A separate $250.00 cleaning fee will be assessed for smoking indoors.
- Drugs, including marijuana are not permitted in or around the condo.
- If you are traveling with small children, please keep constant watch over them when on the balcony.
- Absolutely no fires on property including candles.
- Security camera on the front door for your protection. It's only checked if we are made aware of a disturbance.
- All damage must be reported, no matter how small.
- No pets - The HOA does not allow pets for guests. If an unauthorized pet is brought into the condo, a separate $500.00 cleaning fee will be assessed, and you will be asked to leave without a refund.
-No refunds for weather, cable or internet outages.
- By entering into this rental agreement, the renter and their guests accept full responsibility for the use of the condo and its amenities, and waive any liability by the owner.
